This position is responsible for the research and preparation of easement documents for the installation and maintenance of Duke Energy's Distribution system. This would include researching of Company and public records to determine ownership of property or prior rights, review and interpretation of engineering drawings and site plans; review of legal descriptions; preparation of easement documents; acquire and prepare documents for new service; review, tracking and processing of easement documents to comply with corporate policy and state law, support the processing and transmittal of easement packages to the Data Management Specialists and GIS.

Duties & Responsibilities

* Utilize working knowledge of real estate law and engineering discipline and its application to Company acquisition projects.

o Researches public records, internal records, and engineering drawings to determine Company's rights on associated properties. Perform verification work on DOT, municipality related projects for reimbursement.

o Utilize internal/external GIS systems to map easements.

o Research and prepare distribution easement documents in support of the Senior and Land Representatives or Project planners including complex documents such as distribution releases and encroachments.

o Conduct research and take appropriate action to obtain clear title to property, e.g., interview all parties who may have an ownership interest; coordinate requests for attorney prepared title opinions.

o Identify defects in land titles so that at the conclusion of property acquisitions, clear title is acquired, e.g., pays off mortgages, satisfies judgments, pays delinquent taxes, etc.

o Research and review Franchise Agreements and Municipal Charters with Senior and Land Representative and Legal Counsel to determine Company rights.

o Conduct research to determine accurate property ownership by using databases at public facilities and on-line via the internet through Register of Deeds, GIS, Clerk of Court, Google, tax office, etc. and Company permanent archival system

o Assist Senior and Land Representatives in the research of current property ownership; research historical land title to identify existing easements; prepare easement documents, releases, encroachments, abandonments; Provide research for easement verification of existing distribution facilities on government/county/municipal relocations, system improvement, internal/external customer inquiries and claims; collaborate on research with Data Management to ensure the integrity of data tracked

* Establish and maintain effective working relationships with internal and external personnel/groups.

o Work with internal and external customers to resolve right of way issues within established schedule and budget to provide timely construction of Company facilities and efficient utilization of company resources.

o Interfaces with Legal Department personnel on matters relating to real estate law, property title questions, and Federal Energy Regulatory Commission (FERC) related matters.

o Identify opportunities to acquire easements whenever possible to protect Company assets.

o Prepare single service easement documents and mail to customer or hand off to engineering work order preparer or agent. Update and manage Work Management System to reflect most recent activity by Land Services for tracking work request. Directly and immediately communicate information via verbal/e-mail of any barriers anticipated

o Run reports in document management system and review for accuracy of information contained therein

o Act as the point of contact to receive and record distribution documents at the various courthouses; assist Senior and Land Representative with the transmittal of distribution documents

o Assist Senior and Land Representative in writing processes and procedures; researching, analyzing, preparing and processing all Distribution Easement Releases, Vacate/Abandonments and Subordinations

* Remain abreast of current best practices, regulations, and laws relating to all Real Estate functions.

o Researches professional journals and publications.

o Act as subject matter expert for various internal and external systems and websites

o Reviews information disseminated by Legal and Tax Departments, State Boards, etc., on changes to various real estate, tax, safety, and environmental laws and codes and ensures compliance by subordinates.

o Stays abreast of current real estate market conditions through interface with various local, regional, and national real estate professionals, e.g., appraisers, attorneys, negotiators, brokers, other real estate managers outside of Duke Energy

o Participates in professional organizations and associations. Stays in touch with issues from the International Right-of-Way Association.

Basic/Required Qualifications:

* Associates Degree in Business, Survey, Real Estate, Law or related field; or Paralegal Certification with 1-3 years of work related experience; 3-5 years of prior work related experience in lieu of a degree (e.g., Real Estate Paralegal, Legal Assistant, Preparation of legal documents, experience with researching for Register of Deeds)

* Good communication skills

Licenses, certifications or registrations: Valid Driver's License; Notary Public – can be acquired within first year of employment

Desired Qualifications:

* 4-yr degree in Real Estate, Business, Survey, Law, Paralegal or related field

* 2 years direct experience in acquisition and/or research of real estate rights

* Knowledge of Electric Distribution and Transmission systems, Operations and Construction

* Knowledge of real estate law to include paralegal training

* Experience in title examination related to easements

* Knowledge of surveying and engineering drawings
